The procuratorial organ is the national legal supervision organ, has the legal supervision duty to any kind of lawsuit. Administrative Public interest Litigation is an administrative lawsuit related to social public interest, and the procuratorial organ also has the duty of legal supervision to the Administrative Public interest Litigation. However, in the prosecution of administrative public interest litigation, the procuratorial organs in what capacity to participate in the proceedings and in what position? It is necessary and feasible for procuratorial organs to initiate administrative public interest litigation in order to perfect the system of administrative public interest litigation in our country. This article expounds the basic outline of administrative public interest litigation and the present situation of administrative public interest litigation in China to deepen citizens' awareness of administrative public welfare. Then, referring to the subject qualification of administrative public interest litigation filed by foreign countries, this paper probes into the subject qualification of administrative public interest litigation in our country. Finally, the paper analyzes the basis of procuratorial organs to file administrative public interest litigation, and analyzes and consummates the system of public interest litigation initiated by procuratorial organs. Through the research of the procuratorial organ to initiate the administrative public interest litigation, the public interest of our country can be further protected and the legal guidance is realized, and some suggestions are put forward to perfect our country's administrative public interest litigation system in the administrative public interest litigation system.
