Work role right attribute and protection
Abstract
Elaborated according to the work role classification to its related right attribute that has been clear about two kinds of different attributes which the work role has, namely “personality power attribute” and “intellectual property rights attribute”. Through to the work role right in the domestic and foreign protection condition's analysis, proposed our country mainly the flaw question which exists in the work role right protection, simultaneously and proposed as soon as may draw support from overseas “the vivid power” to mention the solution current work role protection question, the vivid power's production is because the traditional personality power had already had the property change, through to the vivid power's nature's analysis, summarized to the vivid power concept, namely “the vivid power was one kind of emerging personification commercial intellectual property rights”, as a result of the economical swift development, purely could not solve well from the personality power law or in the intellectual property rights law stratification plane Related legal matter, therefore establishes “the vivid power” in our country to consummate the current our country law about the work role right protection question is very necessary。
