Abstract
On the second revision of the Code of Criminal Procedure
China's criminal system has been made great progress，However, both the basic framework and specific procedures have the necessary to reform . In order to meet the needs of system integration and the international development of socio-economic environment and promote judicial reformation, the current Criminal Procedure Law should be amended；We should not only change the concept of justice, but also sum up the practical experience .In the process of amendment, we should correctly handle the relation between constitutional system and criminal justice reform, crime control and protection of human rights, justice and efficiency of the proceedings, advanced foreign experience and our national conditions.The two major object of amendment are to protect the human rights in the legal procedure and realize the justice and the efficiency of the crimianal judicial system .The basic concept of amendment including improving criminal coercive measures and strengthening the protection of the rights of the defence.Through the amendment, the Code of Criminal Procedure is to satisfy the need of modern democratic onecountry ruled by law, and it is to link up the standards of international criminal justice , and it has a comprehensive form which in line with China's national conditions.
