Abstract
In the last few years, under dual function of village push and city pull, more and more farmers go into the city for work. They have done the contributions on national development and urban boom. However, not in a way suited to this peasant workers have not been taken on by citizens. The first problem after they entered the city is that the survival of their own employment rights and interests are not duly protected. So studying on the labor and employment protection without fail to solve the social problems and advance social stabilization and harmonize the city and countryside.
The body of the thesis consists of three parts. The first part is related to the present condition of the labor and employment protection of peasant workers. It briefly introduces the background, status of peasant workers’ labor and employment protection and the importance which resolve the issues of peasant workers’ labor and employment protection. The second part analyzes the reasons of absent labor and employment protection of peasant workers. The existing management system and mechanism is the main reason which causes absence of labor and employment protection. The driving of local interest, not a sound legal system in existence, weak functions of labor union in non-public sectors and the quality of peasant workers are also the important reasons. The third part comes up with some measures to protect the peasant workers’ labor and employment rights, including the establishment of reasonable protection of peasant workers’ labor and employment system, strengthen the governmental responsibility, perfection the legal system of the peasant workers’ labor and employment protection, given labor unions full play and improvement their own the cultural quality, and other measures.
